Ruling On Working In A Mixed Environment
He works in a mixed environment in a non-Muslim country; should he leave it and take unemployment benefit or carry on working there?
I work part-time in a free mixing environment due to religious purposes i do not want to work there full-time and want to leave the job. The earnings i recieve is not enough. i have applied for jobseekers allowance(benefit) to help myself fiancially. is it permissible for me to still work there and recieve the benefit, until i get myself a desent job?.
Praise be to Allah.
Firstly:
What the Muslim should do is earn his living with his own hands, and refrain from taking people’s wealth. It is not the characteristic of the Muslim to look for the wealth that is in other people’s hands, let alone take it unlawfully. If a Muslim is living in a non-Islamic state, then it is even more necessary for him to refrain from taking their wealth, and he should not humiliate himself by seeking the help that these countries offer to those who are unemployed, as working hard and striving to earn a living is better for him than humiliating himself.
Al-Khateeb al-Baghdaadi narrated in Tareekh Baghdaad (10/160) that ‘Ali ibn al-Fudayl said: I heard my father say to Ibn al-Mubaarak: You enjoin asceticism upon us, and making do with little, but we see you bringing goods from Khorasaan to the land of al-Haraam [Makkah] How is that? Ibn al-Mubaarak said: O Abu ‘Ali, I only do that to protect my dignity and my honour, and I seek help thereby to obey my Lord. I do not see any duty to Allaah but I hasten to do it. al-Fudayl said to him: O Ibn al-Mubaarak, how good it is if you do this!
Secondly:
With regard to taking help (benefits) from the government – whether it is Muslim or not – when you are not entitled to it and you do not meet the conditions stipulated, that is haraam wealth and you must avoid it.
Allah has commanded us to fulfil covenants and promises, even with the disbelievers. Allah says (interpretation of the meaning): “O you who believe! Fulfil (your) obligations” [al-Maa’idah 5:1]. Between you and the state there is a covenant whereby entitlement to this money is subject to conditions, so the conditions must apply to you in order for their wealth to become permissible for you.
If a person is working and has a salary, then he is not entitled to any help (benefits). If he does not work despite the availability of opportunities for permissible work, then the help is also haraam for him.
With regard to your situation in particular: If you want the money to be permissible, then give up this haraam job in order for these conditions of receiving help to be applicable to you. If a person finds work in a mixed environment, or in a brewery, or in a restaurant that sells haraam meats, he is not regarded as having found work, because it is haraam for him to take that job and there is nothing wrong with him accepting help in that case; that is less serious than earning a haraam income or the possibility of facing fitnah (temptation) from the opposite sex.

Il travaille dans un milieu de mixité et dans un pays de mécréants. Doit il abandonner son travail et se contenter d'une allocation de chômage ou garder son emploi?
Je travaille à mis temps dans une ambiance de mixité. Je ne veux pas travailler à plein temps pour des raisons religieuses . Mon revenu étant insuffisant, je me suis inscrit pour bénéficier d'une allocation chômage appelée "Job seakers loans".C'est une somme que le Gouvernement accorde aux chômeurs à la recherche d'un emploi afin de leur permettre de couvrir leurs besoins fondamentaux jusqu'à leur obtention d'un emploi. M'est il permis de conserver l'assistance gouvernementale jusqu'à ce que je trouve un emploi bien rémunéré?

Premièrement, le musulman doit gagner sa vie grâce à la sueur de son front et se garder de solliciter les gens. La convoitise des biens des autres ne fait pas partie des caractéristiques du (vrai) musulman. Aussi est il loin de vouloir prendre des biens d'autrui d'une manière illégale. Si le musulman vit dans un pays non musulman, il doit observer une plus grande méfiance envers les biens des non musulmans. Il ne doit pas se faire humilier à travers la recherche d'une assistance accordée par ses pays aux chômeurs. Il vaut mieux qu'il travaille durement au lieu de s'abaisser.
Al-Khatib al-Baghdadi a rapporté dans l'histoire de Baghdad (10/160) qu'Ali ibn al-Foudhayl a dit: «J'ai entendu mon père dire à Ibn al- Moubarak: tu nous recommandes le renoncement et la sobriété, mais nous voyons que tu importes des marchandises de Khourassan aux Lieux Saints…Comment ça?» Al-Moubarak lui répondit: «Ô Abou Ali, je fais ce que tu dis pour préserver ma dignité et me permettre de bien obéir à mon Maître. Je ne vois aucun de Ses droits que je ne m'empresse d'acquitter.» Al- Foudhayl lui dit: «Que ce beau, s'il en est ainsi!»
Deuxièmement, s'agissant de l'allocation du Gouvernement, qu'il soit musulman ou non, vous ne la méritez pas puisque vous ne remplissez pas les conditions requises. Dès lors, le revenu que vous recevez fait partie des biens mal acquis qu'il faut éviter. Allah nous a donné l'ordre de respecter les contrats et accords, fussent ils conclus avec des mécréants. A ce propos, le Très Haut dit : «Ô vous qui croyez! Honorez les contrats » (Coran,5:1).un contrat vous lie à l'Etat en vertu duquel vous ne méritez l'allocation chômage qu'à la condition d'être chômeur. Pour que le revenu soit licite, il faut remplir cette condition. Celui qui exerce un emploi rémunéré ne peut percevoir une allocation chômage. S'il ne travaille pas malgré l'existence d'opportunités d'emploi licite, la perception d'une assistance lui est prohibée. En ce qui vous concerne , en particulier, si vous voulez rendre votre revenu licite, abandonnez l'emploi prohibé pour devenir un vrai chômeur. Quiconque trouve un travail dans un milieu de mixité, dans une brasserie ou dans un restaurant où des viandes prohibées sont servies, on ne le considère pas (islamiquement) comme un travailleur, car il exerce une activité interdite. Par conséquent, il lui est permis de toucher l'allocation en question, cela étant moins grave que de commettre l'interdit ou de rester sous la tentation des femmes.
