She Works In A Company Is Owned By Numerous Partners Including Riba-based Banks
I work in a company whose capital is funded by five different partners,including two riba-based banks.
These partners who founded this company own a piece of land and they are bringing in utilities such as drainage, electricity and water, then they will divide it and sell it to purchasers, selling it either for cash or by instalments,with a fixed annual interest rate of 7%; please note that the transactions may not go through in some cases. My job in this company is in the secretarial division (administration work). I have been spending and saving from my salary during the time I have worked for this company, which is now 5 years, and I did not know that there might be something dubious about this money and these savings in an Islamic bank. Is my work in this company whose wealth is mixed halaal or haraam? What is the ruling on the money that I have saved, and how should I dispose of it? If it is only makrooh, will I enter the fire of Hell or be punished because of it? Please advise me and save me from this confusion and torment that I am in.
Praise be to Allah.
Firstly:
Working for companies whose wealth is mixed is makrooh, according to the majority of scholars, but it is not haraam unless the work itself is haraam or involves helping others in doing things that are haraam, such as working in the riba-based bank itself.
Makrooh does not mean haraam, so the one who does that is not sinning, but it is better for the Muslim not to do that and to avoid it, and to look for work that is permissible.
Secondly:
Selling by instalments is permissible, but two points should be noted:
1. The contract should be free of clauses imposing a penalty in the event of late payment, because this is stipulating riba, and it is not permissible to write such a clause or sign for it.
2. The instalment plan should be made directly by the company that owns the product, with no involvement of any riba-based bank.That is because the involvement of the riba-based bank in this transaction means that it will pay the whole amount on behalf of the purchaser,then it will receive the instalments,so in fact this contract is a riba-based loan. The bank will lend the agent one hundred, for example, and the agent pays it on behalf of the bank to the seller, then it will take one hundred and twenty in instalments. This is forbidden riba, as is obvious.
Thirdly:
If the company is selling the land in a permissible manner – without the intervention of a riba-based bank – then your work is permissible and the salary that you get is permissible. But it is better for you to look for purely halaal work, as stated above.
If the company is selling it in a haraam manner, such as if it stipulates late-payment penalties, or the bank is involved in the instalment payments, then we should look at the nature of your work in this case. If it involves helping in this haraam transaction, such as writing or recording or checking etc, then your work is haraam, and the salary that you get from it is haraam, but what you took before you found out that it is haraam is yours to keep and you do not have to give it in charity.
Whatever you got after you found out that it is haraam, you should get rid of it by giving it in charity, and you must also leave this job.
If the job you do is partly permissible and partly haraam, then you should strive to work out how much of it is haraam and get rid of the corresponding amount of your salary. See question no. 81915.

Je travaille pour une société appartenant à plusieurs actionnaires dont deux banques usurières. Cette société, fondée par lesdits partenaires, possède un domaine et s'est mise à le viabiliser en y amenant de l'électricité, de l'eau et en le dotant d'un réseau d'évacuation des eaux usées. Elle s'est mise à le morceler pour le vendre à des promoteurs immobiliers. Les acquéreurs peuvent payer cash ou par tranches assorties d'intérêts annuels fixés au taux de 7%. Les opérations de vente sont arrêtées parfois. Je travaille dans le secrétariat de la société où j'exerce un emploi administratif. Durant cinq années d'activités dans la société, je dépensais une partie de mon salaire et en épargnais une autre. Je ne savais pas que mes fonds étaient suspects. Mon épargne est déposée dans une banque islamique. Est-ce que le fait pour moi de travailler dans une société dont le capital comporte un mélange de fonds licites et illicites est interdit? Comment juger les sommes épargnées et que faut il en faire? Si mon activité n'est que réprouvée, m'enverrai –t-elle en enfer? M'entraînerai –t-elle un châtiment? Répondes moi utilement et de façon à me sauver de la perplexité et de la souffrance.

Il n'est interdit que si l'activité exercée est elle-même interdite ou implique un concours à la réalisation de ce qui est interdit, comme la contribution au fonctionnement d'une banque usurière. Ce qui est réprouvé n'est pas interdit. Son auteur ne commet pas un péché, même s'il convient au musulman de l'éviter et de chercher un travail totalement propre.
Deuxièmement, l'achat par tranches est autorisé. Mais il faut faire attention à deux choses. La première est que le contrat de vente ne doit pas prévoir une pénalité en cas de retard de paiement, une telle conditionnalité impliquant l'usure et partant jugée caduque et à ne pas signer. La deuxième est que les mensualités doivent être payées directement à la société qui possède l'article vendu. Il ne faut pas qu'une banque usurière serve d'intermédiaire. Car si une telle banque intervient dans l'opération, elle paye la totalité du prix à la place de l'acheteur puis perçoit des mensualités. Or tout contrat de cette nature équivaut à un prêt à intérêt. La banque prête 100 au client, remet l'argent à sa place au vendeur et perçoit 120 par mensualités. Ce qui est évidemment l'usure interdite.
Troisièmement, si la société vend des parcelles licitement, sans l'intervention d'une banque usurière, vos activités sont licites comme votre salaire. Cependant, il vaut mieux que vous cherchiez un autre emploi, comme nous l'avons déjà dit. Si la société mène des opérations de vente illicites, si elle perçoit une pénalité de retard de paiement, si la banque intervient dans le paiement par tranches, il faut alors examiner la nature la nature de vos activités; si elles concourent à la réalisation de ce qui est interdit, que cela soit par écrit, par l'enregistrement ou par la vérification (des opérations), vos activités sont alors interdites et votre salaire illicite.
Quant à ce que vous avez perçu avant de savoir que ce que vous faisiez était interdit, il vous appartient, et vous n'avez pas à en faire une aumône. S'agissant de ce que vous avez perçu après avoir appris le caractère illicite de vos activités, vous devez vous en débarrasser en l'offrant en aumône, tout en cessant l'exercice de votre emploi. Si le licite et l'illicite se mélangent dans vos activités, vous faites de votre mieux pour estimer la part de l'illicite et vous débarrasser de son équivalent du salaire. Si vos activités ne concourent pas à la réalisation d'un produit illicite, si, par exemple, vous travaillez dans un secteur sans rapport avec la vente par tranches, nous espérons que vous n'encourez rien en maintenant votre travail.
