He got his university certificate through an intermediary and got a job with it. What should he do?
I was studying in one of the university faculties, but I was not able to complete my studies and I got the certificate through an intermediary, then I got a job with this certificate, and I got married by having this job, and now I have two children.
My question is:
What is the shar’i ruling on this – knowing that I do my job well and my boss has written a report proving my efficiency?.
Praise be to Allah.
Firstly:
Getting your certificate through an intermediary when you did not deserve it is a haraam action,which involves a number of things that are forbidden. The one who intervened for you is a partner in the haraam action. The haraam actions which resulted from you obtaining this certificate through an intermediary are as follows:
(a) It was intercession for an evil cause. Allah says (interpretation of the meaning):
“Whosoever intercedes for a good cause will have the reward thereof, and whosoever intercedes for an evil cause will have a share in its burden. And Allah is Ever All-Able to do (and also an All-Witness to) everything”
[Surah an-Nisa’ 4:85]
al-Haafiz ibn Hajar (may Allah have mercy on him) said:
The reward for intercession is not general in meaning, rather it applies only to cases where the intercession is allowed, which is intercession for a good cause.That applies only to things which are allowed in shariah, not to things that are not allowed, as indicated in this verse. At-Tabari narrated with a sahih isnad that Mujahid said: this applies to intercession of people for one another. To conclude, whoever intercedes for another in a good cause will have a share of the reward, and whoever intercedes for another in a false (bad) cause will have a share of the burden of sin. End quote.
Fathul-Bari, 10/451, 451
(b) It was deceit, because you submitted papers that were not valid.
It was narrated from Abu Hurayrah (may Allah be pleased with him) that the Messenger of Allah (peace and blessings of Allah be upon him) said: “Whoever deceives us is not one of us.” Narrated by Muslim, 102
(c) You pretended to be something that you are not – by claiming that you had obtained a certificate when that was not the case.
It was narrated from Asma’ (may Allah be pleased with her) that the Prophet (peace and blessings of Allah be upon him) said: “The one who claims to have what he does not have is like one who wears two false garments (i.e., that do not belong to him).”
Narrated by al-Bukhari, 4921; Muslim, 2130
(d) False speech and false testimony
It was narrated that Abu Bakrah (may Allah be pleased with him) said: The Messenger of Allah (peace and blessings of Allah be upon him) said:“Shall I not tell you of the worst of major sins?” We said: Yes, O Messenger of Allah. He said: “Associating anything with Allah, disobeying one's parents,”and he was lying down but he sat up and said: “And false speech and false testimony, and false speech and false testimony,”and he kept saying it until we wished that he would stop (out of compassion towards him).
Narrated by al-Bukhari, 5631; Muslim, 87.
(e) Lying to the bosses at work and to other people.
It was narrated from Abu Hurayrah (may Allah be pleased with him) that the Prophet (peace and blessings of Allah be upon him) said: “The signs of the hypocrite are three: when he speaks he lies, when he makes a promise he breaks it, and when he is entrusted with something he betrays (that trust).”Narrated by al-Bukhari, 33; Muslim, 59.
(f) Taking away the rights of others who had obtained genuine certificates without the intercession of anyone else.This is unjust towards those who were deprived of their right to a job.
It was narrated from Abu Dharr (may Allah be pleased with him) that the Prophet (peace and blessings of Allah be upon him) narrated that Allah,may He be blessed and exalted, said: “O My slaves,I have forbidden injustice to Myself and I have made it haram among you, so do not be unjust towards one another.”
Narrated by Muslim, 2577.
So you can see the seriousness of what you have done, since it involves so many sins and wrong actions. What you – and the one who interceded for you – have to do is to repent sincerely, by regretting what you have done, resolving not to do it again, praying for forgiveness and doing acts of worship.
Secondly:
With regard to your work and the money you have earned by having this certificate, we hope that your repentance will be sufficient to solve this problem, so long as you do your work well.

Il a eu son diplôme universitaire grâce à une intervention et il a obtenu un emploi… ?
J’ai étudié dans un établissement universitaire. N’ayant pas terminé mes études, j’ai eu mon diplôme grâce à une intervention. Et puis j’ai trouvé un emploi grâce à mon diplôme. Mon travail m’a permis de me marier. Et j’ai eu deux enfants depuis. Ma question est la suivante :
Comment juger ma situation du point de vue de la charia en tenant compte du fait que je maîtrise parfaitement mon travail et que les rapports d’inspection concernant ma compétence effectués par mon patron sont excellents … ?
Louanges à Allah
L’obtention par intervention d’un diplôme non mérité est interdite. Car elle entraîne plusieurs autres choses prohibées. Celui qui est intervenu en votre faveur est votre complice dans cette pratique interdite. Les choses prohibées consécutives à votre obtention de ce diplôme sont les suivantes :
-La mauvaise intervention à propos de laquelle Allah Très Haut dit : « Quiconque intercède d' une bonne intercession, en aura une part; et quiconque intercède d' une mauvaise intercession en portera une part de responsabilité. Et Allah est Puissant sur toute chose.» (Coran, 4 : 85).
Le terme kifl signifie : part du péché.
Al-Hafiz ibn Hadjar (Puisse Allah lui accorder Sa miséricorde) a dit : « Toute bonne intervention n’est pas génératrice de récompense (divine). Seule l’est l’intervention qui intéresse un domaine dans lequel il est permis d’intercéder. C’est ce qu’on appelle la bonne intercession. Elle consiste précisément à intercéder dans les domaines où la loi le permit, comme l’indique le verset (4 :85). En somme, remportera une part de récompense tout auteur d’une bonne intervention. Et supportera une part du péché toute personne qui intervient pour faire prévaloir le faux ». Fateh al-Bari, 10/451-452.
-La tricherie consistant à présenter de faux papiers.
D’après Abou Hourayra (P.A.a) le Messager d’Allah (bénédiction et salut soient sur lui) a dit : « Le tricheur ne fait pas partie des nôtres ». (rapporté par Mouslim, 102).
-Se targuer d’un titre que l’on ne possède pas réellement. Car l’intéressé prétend avoir obtenu un diplôme. Ce qui n’est pas vrai.
D’après Asma (P.A.a) le Prophète (bénédiction et salut soient sur lui)a dit : « Celui qui se targue (de qualités) qu’il n’a pas est comme quelqu’un qui porte de faux vêtements » (rapporté par al-Boukhari, 4921 et par Mouslim, 2130).
-Tenir de faux propos et faire un faux témoignage
D’après Abou Bakr le Messager d’Allah (bénédiction et salut soient sur lui) a dit : « Ne vais-je pas vous apprendre le plus grave des péchés ?
-«Si, ô Messager d’Allah »
-« le fait d’associer quelqu’un à Allah, le mauvais traitement de ses père et mère. A cet instant, il se mit assis après s’être accoudé. Et puis il dit : attention ! Et les faux propos et le faux témoignage » Et il ne cessa de répéter cette phrase jusqu’à ce que nous souhaitâmes qu’il se tût » (rapporté par al-Boukhari, 5631 et Mouslim, 87).
-Mentir au patron et aux gens
D’après Abou Hourayra (P.A.a) le Messager d’Allah (bénédiction et salut soient sur lui) a dit : «Les signes (caractéristiques) de l’hypocrite sont au nombre de trois : « un discours mensonger, des promesses non tenues et la trahison en cas de confiance » (rapporté par al-Boukhari, 33 et par Mouslim, 59.
-Usurper la place d’un autre qui a obtenu un vrai diplôme sans intervention. Ce qui est une injustice à l’égard des diplômes non employés.
D’après Abou Dharr (P.A.a) le Prophète (bénédiction et salut soient sur lui) reçut d’Allah Très Haut et Béni les propos que voici : « Mes serviteurs! Je me suis interdit l’injustice et vous l’ai interdite ; ne vous lésez pas les uns les autres » (rapporté par Mouslim, 2577).
Vous voyez ainsi que la gravité de l’acte résulte de la multiplicité des péchés qu’il implique et les violations qui en découlent. Celui qui est intervenu en votre faveur et vous-mêmes devez procéder à un repentir sincère en regrettant ce que vous avez fait et en vous décidant de ne plus récidiver, en sollicitant le pardon et en veillant à l’accomplissement d’actes d’obéissance…
Deuxièmement, s’agissant de votre travail et de vos gains résultant de la présentation de votre diplôme, nous espérons que votre repentir suffira à les rendre licite puisque vous maîtrisez votre travail et le faites excellemment.

D’après Abou Dharr (P.A.a) le Prophète (bénédiction et salut soient sur lui) reçut d’Allah Très Haut et Béni les propos que voici : « Mes serviteurs! Je me suis interdit l’injustice et vous l’ai interdite ; ne vous lésez pas les uns les autres » (rapporté par Mouslim, 2577).
Vous voyez ainsi que la gravité de l’acte résulte de la multiplicité des péchés qu’il implique et les violations qui en découlent. Celui qui est intervenu en votre faveur et vous-mêmes devez procéder à un repentir sincère en regrettant ce que vous avez fait et en vous décidant de ne plus récidiver, en sollicitant le pardon et en veillant à l’accomplissement d’actes d’obéissance…
Deuxièmement, s’agissant de votre travail et de vos gains résultant de la présentation de votre diplôme, nous espérons que votre repentir suffira à les rendre licite puisque vous maîtrisez votre travail et le faites excellemment.
