Is it permissible to delay payment of salaries to employees?
I work in a company as an accountant, and all the financial transactions and cheques pass through me. The owner of the company pays zakaah but he delays payment of salaries to employees by three months. Is that permissible?.
Praise be to Allah.
It is not permissible to delay payment of salaries to employees beyond the time when they are due, which is when the work is completed or at the end of the agreed-upon period. If the agreement is that the salary be paid monthly, then it must be paid to the worker at the end of each month; delaying it with no excuse is regarded as unfair and unjust. Allah says (interpretation of the meaning):
“Then if they give suck to the children for you, give them their due payment”
[Surah at-Talaaq 65:6]
So Allah commanded that they be given their payment as soon as the work is done.
Ibn Majah (2443) narrated that ‘Abdullah ibn ‘Umar (may Allah be pleased with him) said: The Messenger of Allah (peace and blessings of Allah be upon him) said: “Give the worker his wages before his sweat dries.” Classed as sahih by al-Albani in Sahih Ibn Majah.
What this means to hastening to give him his dues as soon as the work is done. Similarly, when the agreed-upon period ends (which is one month in the case of most employees nowadays), then it is obligatory to hasten to give him his dues.
Al-Manawi said in Fayd al-Qadeer:
It is haraam to delay and postpone when one is able to pay. The command to give it to him before his sweat dries is a metaphor for the obligation to pay him as soon as the job is done, even if he does not sweat, or if he sweated and it has dried. End quote.
The company owner’s delay in paying the salaries is wrongdoing which makes his honour and punishment permissible, as the Prophet (peace and blessings of Allah be upon him) said: “Withholding of payment by a rich man is wrongdoing.”Narrated by al-Bukhari (2400), Muslim (1564).
And the Prophet (peace and blessings of Allah be upon him) said: “If one who can afford it delays payment, his honour and punishment become permissible.”Narrated by Abu Dawood (3682), an-Nasa’i (4689) and Ibn Majah (2427), classed as hasan by al-Albani in Irwa’ al-Ghaleel, 1434.
What is meant by his honour becoming permissible is that one may say, “So and so delayed paying me and he wronged me.” Punishing him means detaining him. This is how it was interpreted by Sufyan and others.
The Standing Committee was asked about a boss who did not give his workers their salaries until they traveled to their homelands once every year or two, and the workers agreed to that because they have no choice, job opportunities are few, and they need the money.
They replied: What this boss should do is to give his workers their salaries at the end of every month, as is the custom among people nowadays. But if there is an agreement and they accept that the salary will be paid all together after one or two years, there is nothing wrong with that, because the Prophet (peace and blessings of Allah be upon him) said in a sahih hadith: “The Muslims are bound by their conditions.” End quote.

Based on the above, you should advise the company owner and explain to him that it is haraam to delay the employees’ salaries and it is haraam to harm them.

Il n’est pas permis de retarder le paiement des salaires dus aux employés pour services effectués. Si, selon le contrat de travail, le salaire doit être payé mensuellement, l’employeur doit s’y conformer à la fin de chaque mois ; tout retard non excusable devient un atermoiement injuste. A ce propos, le Très Haut dit : «si elles allaitent (l' enfant né) de vous, donnez- leur leurs salaires.» (Coran, 6 : 65). Il donne ainsi l’ordre de leur remettre leurs salaires dès la fin de leurs services. Ibn Madia (n° 2443) rapporte (dans le même sens) d’après Abd Allah Ibn Omar (bénédiction et salut soient sur lui) que le Messager d’Allah (bénédiction et salut soient sur lui) a dit : « Donnez à l’employé son salaire avant même que sa sueur ne se dessèche » (déclaré authentique par Al-Albani dans Sahihi Ibn Madia).
Il s’agit dans ce hadith de donner à l’employé son droit dès la fin du travail. C’est ce qu’il faut faire selon la périodicité convenue (c’est-à-dire à la fin de chaque mois dans la plupart des emplois). Il faut alors donner à l’employé son droit sans tarder.
Al-Manawi dit dans Fayath al-Qadir : « Il est interdit à l’employeur de tergiverser tout en étant en mesure de payer le salaire. Le fait de demander à l’employeur de payer le salarié avant que sa sueur ne se dessèche est une manière d’exprimer la nécessité de donner le salaire dès l’accomplissement du service, même s’il n’y a pas de sueur.
Les atermoiements de l’employeur à propos du paiement des salaires constituent une injustice qui justifie qu’on lui adresse des critiques et lui inflige une peine en vertu de la parole du Prophète (bénédiction et salut soient sur lui) : « les atermoiements d’un créancier solvable constituent une injustice » (rapporté par al-Boukhari, n° 2400 et par Mouslim, n° 1564). Les termes : matl et mumatala signifient atermoiements.
Le Prophète (bénédiction et salut soient sur lui) a dit encore : « Les tergiversations du solvable justifient qu’on le dénonce et lui inflige une peine » (rapporté par Abou Dawoud, 3628 et par an-Nassaï, 4689 et par Ibn Madia, 2427 et déclaré bon par al-Albani dans Irwa al-Ghalil, 1434.
Le terme : layy signifie tergiversation
Le terme : wadjid signifie solvable
L’expression : yuhillu irdhahu signifie : lui autorise à dire : un tel retarde injustement le paiement de mon dû. Lui infliger une peine, c’est l’emprisonner selon Soufyan et d’autres.
Les ulémas de la Commission Permanente ont été interrogés à propos du cas d’un employeur qui ne paye les salaires de ses employés que quand ceux-ci rentrent chez eux au bout d’une année ou deux… Les employés y consentent à défaut d’un autre choix et en raison de la rareté des opportunités de travail et à cause de leur manque d’argent.
Voici leur réponse : « l’employeur doit payer les salaires de ses employés à la fin de chaque mois selon la coutume en vigueur aujourd’hui. Si toutefois il y a un arrangement volontairement admis selon lequel les salaires peuvent être cumulés et payés une fois par an ou tous les deux ans, il n’y a pas d’inconvénients, compte tenu de la parole du Prophète (bénédiction et salut soient sur lui) dans ce hadith authentique : « les musulmans doivent se conformer aux conditions qu’ils établissent entre eux ».

Etant donné ce qui précède, il convient de prodiguer des conseils à l’employeur pour lui expliquer l’interdiction de retarder le paiement des salaires de ses employés comme il est interdit de leur porter préjudice.
